Shields persons from civil and criminal liability for climate-related damage or injury caused by greenhouse gas emissions, unless they violated specific statutory emission limits or permit terms

Removes the previous requirement that a person must reside or do business in Utah to receive liability protection

Expands the definition of "greenhouse gas" to include carbon dioxide, methane, nitrous oxide, sulfur hexafluoride, hydrofluorocarbons, perfluorocarbons, and nitrogen trifluoride (whether from human activity or natural sources)

Requires plaintiffs to prove by clear and convincing evidence that unavoidable, identifiable damage resulted directly from the defendant's violation of statutory or permit limits

Takes effect May 6, 2026
