Prosecutors must offer a plea in abeyance to first-time offenders aged 18+ charged with retail theft, underage alcohol possession/consumption, or misdemeanor controlled substance possession.

Plea in abeyance agreements for qualifying offenses cannot require incarceration or fees of $200 or more.

Defendants may perform compensatory service at $12 per hour in lieu of paying fines, fees for plea in abeyance agreements, or bail amounts.

Compensatory service cannot substitute for victim restitution payments.
