County recorders may accept digitally authenticated records (electronic documents verified using tamper-evident technology) after obtaining approval from the State Archives and presenting proposals to the Records Management Committee in a public meeting.

Counties must submit detailed proposals to the State Archives describing their proposed digital authentication system, security measures, training plans, and consultations with the Title and Escrow Commission, County Recorder Standards Board, and affected industry stakeholders.

The state archivist must provide written approval or denial within 45 days of receiving a county proposal; approvals are valid for three years and may be renewed with demonstrated continued compliance.

The state archivist, in consultation with the Division of Technology Services, must establish rules for digital authentication technical standards including security requirements, cybersecurity standards, retention schedules, and preservation procedures for long-term archival storage.
