Division of Air Quality may impose annual aggregate compliance fees on aggregate operations (sand, gravel, stone extraction facilities) from July 1, 2027 to June 30, 2028, ranging from $750 for operations with 20 tons or less of annual emissions up to $4,500 for operations with 99+ tons of annual emissions

Air Quality Board gains authority to set aggregate compliance fee amounts by administrative rule beginning July 1, 2028

Fugitive dust facilities larger than a quarter acre that are required to have a dust control plan must post publicly visible signage at entryways displaying facility name, permit ID number, business ID number, and contact information for both the facility manager/owner and the Division of Air Quality

Fugitive dust facilities include aggregate operations, excavation sites (trenching, grading, drilling, earthmoving), and bulk material handling sites, but exclude agricultural/horticultural operations and roadway sanding/salting for ice control

Effective date is May 6, 2026
