Kratom processors and retailers must register with the Utah Department of Agriculture and Food, with registration fees set by the department and administrative fines up to $5,000 for unregistered sellers

Prohibits sale of kratom extracts, products not identifiable as plant matter, and products mixed with non-inert substances; only allows inert encapsulating agents with no pharmacological activity

Raises the minimum purchase age for kratom products from 18 to 21 years old

Increases criminal penalties for violations: first offense is now a class B misdemeanor (up from class C), second offense is a class A misdemeanor, and third or subsequent offenses are third-degree felonies

The Kratom Consumer Protection Act automatically becomes inoperative if all alkaloids in the Mitragyna speciosa plant are classified as controlled substances under state law; effective date is May 6, 2026
