Prohibits school administrative and instructional personnel from implementing, measuring, tracking, grading, or collecting data on "character education," defined as interpersonal or intrapersonal competencies related to attitudes, beliefs, mindsets, dispositions, identity, or values that are subjective or open to interpretation

Establishes that character formation and moral education of children is solely the privilege and purview of parents, not the state, citing protections under the Utah Constitution and 1st, 4th, 9th, and 14th amendments to the U.S. Constitution

Requires the state auditor to receive complaints, investigate violations, publish compliance dashboards, and withhold funds from non-compliant public entities; entities with three or more violations in five years may be designated non-compliant and referred to the U.S. Department of Justice

Creates a private right of action allowing parents to sue public entities for violations, with recovery of actual damages, attorney fees, and court costs if successful

Replaces repealed character education provisions with new "Constitutional government education" requirements, mandating instruction on the Declaration of Independence, U.S. and Utah constitutions, branches of government, free enterprise, and limited government powers; takes effect July 1, 2026
