Residents or their representatives may appeal an assisted living facility's discharge or transfer decision by submitting a form to the department within 30 days of receiving notice

Facilities cannot discharge or transfer a resident while an appeal is pending, unless failure to do so would endanger the health or safety of the resident or others

Hearings must be conducted within 30 days of the request, or within 7 business days if the resident requests an expedited hearing; hearings may be held in person or virtually

Facilities bear the burden of proving the discharge or transfer is justified, and may only discharge residents for specific reasons: facility closure, resident policy violations, nonpayment, resident request, or inability to meet resident's medical or safety needs
