Amends Utah Code 77-7-5 to expand the presumption against issuing arrest warrants in lieu of summons to include cases where a magistrate issued a temporary pretrial status order releasing the accused, and the prosecutor files for a warrant more than seven days after release

Requires prosecutors attempting to serve a summons to make good faith efforts including delivering a copy to the accused's attorney of record or obtaining contact information from the attorney if known

Allows the presumption against warrants to be overcome if the prosecutor presents new evidence not known to the magistrate at the time of the accused's release from jail

Defines daytime hours as 6 a.m. to 10 p.m. and nighttime hours as 10 p.m. to 6 a.m. for purposes of executing arrest warrants

Takes effect May 6, 2026
