VA HB1326

Allows prisoners aged 65+ who have served at least 5 years, or aged 60+ who have served at least 10 years, to petition the Parole Board for conditional release

Excludes prisoners convicted of Class 1 felonies from eligibility for geriatric conditional release

Adds new exclusions for offenses committed on or after July 1, 2026, including first-degree murder, felony murder, murder by poison, second-degree murder, mob-related killings, and most felony sexual assault crimes

Bars eligibility for second or subsequent felony convictions of certain violent crimes including manslaughter, malicious wounding, arson of occupied structures, burglary, child pornography production, and cross burning/terrorism offenses

Limits prisoners convicted of excluded offenses to parole review only once every 10 years, and requires the Parole Board to promulgate implementing regulations
