VA HB1364

Prohibits employers from discharging or taking adverse personnel action against employees who serve as members of the Virginia General Assembly due to absences for legislative duties

Prevents employers from requiring legislators to use sick leave or vacation time when absent for General Assembly sessions or committee meetings

Covers absences for regular sessions, special sessions, and meetings of legislative committees, subcommittees, commissions, councils, or other entities where the member serves

Establishes violation of these protections as a Class 3 misdemeanor (punishable by a fine up to $500 in Virginia)

Adds new section 30-9.1 to the Code of Virginia; introduced by Delegate Henson in January 2026
