VA HB1398

Establishes the Fetal and Infant Mortality Review Team within the Virginia Department of Health to review deaths of fetuses after 20 weeks gestation and infants under age one, with the goal of reducing fetal and infant mortality and improving maternal and infant health outcomes

Requires the Team to include representatives from the Department of Health, medical professionals (obstetricians, pediatricians, nurses, midwives), medical examiners, social services, and relevant community organizations, with appointments made by the State Health Commissioner

Grants the Team access to medical records, vital statistics, social services records, and other confidential information necessary for case reviews, with all information remaining confidential and inadmissible as evidence in legal proceedings

Makes unauthorized disclosure of confidential information obtained during reviews a Class 3 misdemeanor

Requires the Team to submit an annual report to the Governor and General Assembly summarizing findings and recommendations for reducing fetal and infant mortality, with the report due by October 1 each year beginning in 2027
