Allows subpoenas for electronic records, electronically stored information, or documents held outside Virginia by nonparty commercial enterprises to be served by hand, certified mail, commercial delivery service, facsimile, or electronic means

Applies to both domestic and foreign corporations that are transacting or have transacted business in Virginia, regardless of where the records are physically stored

Requires foreign corporations with a registered agent in Virginia to respond to subpoenas in a manner consistent with Virginia law and Supreme Court of Virginia Rules

Extends the new electronic records subpoena service provisions to criminal cases by adding § 8.01-301.1 to the list of civil statutes applicable to criminal proceedings

Amends Virginia Code §§ 8.01-301 and 19.2-267 and creates new § 8.01-301.1, effective for the 2026 legislative session
