Extends the deadline for claiming family allowance, exempt property, or homestead allowance from one year after the decedent's death to one year after either the will is admitted to probate or an administrator qualifies for an intestate estate, whichever is later

Amends § 64.2-313 of the Code of Virginia governing when and how surviving family members may claim estate allowances

Election to claim allowances must still be made in person before the court or by recorded writing with proper acknowledgment

Provides additional time for families to learn of their rights when estate administration begins well after the decedent's death
