Landlords owning more than four rental dwelling units in Virginia must offer tenants a payment plan when unpaid rent equals one month's rent or less plus applicable late charges, before proceeding with eviction

Payment plans must allow tenants to repay the amount owed in equal monthly installments over the lesser of six months or the time remaining on the lease, with no penalty for early full repayment

Landlords cannot charge additional late fees during the payment plan period as long as the tenant makes timely payments under the plan

Tenants have five days after receiving written notice to either pay the full amount owed or enter into the offered payment plan; failure to do so allows the landlord to terminate the rental agreement and pursue eviction

Landlords are only required to offer one payment plan per rental agreement term; subsequent nonpayment after entering a plan allows the landlord to proceed with termination after providing a new five-day notice
