Amends Virginia Code §§ 16.1-340.2 and 37.2-810 to clarify requirements for alternative transportation providers who transport individuals subject to temporary detention orders for mental health evaluation.

Alternative transportation providers are deemed "available" if they can take custody within six hours of order issuance, and "able to provide transportation safely" if they are employees or contractors of the Department of Behavioral Health and Developmental Services or employees of private or state hospitals.

Allows law enforcement or alternative transportation providers to transfer custody of detained individuals to facilities or locations capable of providing appropriate security while awaiting transport, provided agreements are in place.

Authorizes trained employees or contractors of alternative transportation entities to use restraint when necessary for safety or to maintain custody, after less restrictive techniques prove ineffective.

Alternative transportation providers maintain full custody of the individual from the time of transfer from law enforcement until delivery to the temporary detention facility, and are protected from civil liability for ordinary negligence during transport.
