Requires health care providers present during an abortion or attempted miscarriage to provide the same degree of professional care to any infant born alive as would be given to any other child born at the same gestational age

Mandates immediate transfer of any infant born alive following an attempted abortion to a hospital for further medical care

Establishes a Class 4 felony penalty for health care providers licensed by the Board of Medicine who fail to comply with the treatment and care requirements

Exempts the mother of the infant from any criminal prosecution under this section

Requires hospitals to establish protocols for treating infants born alive and mandates immediate reporting to law enforcement of any health care provider's failure to provide required care
