Eliminates the tobacco surcharge that previously allowed health insurers to charge tobacco users up to 1.5 times higher premiums for individual and small group health insurance plans in Virginia

Restricts health carriers to basing premium rates only on individual vs. family coverage, geographic rating areas, and age (with a maximum 3:1 ratio for adults)

Prohibits premium rates from varying based on any factor other than the three specified criteria, removing tobacco use as a permitted rating factor

Applies to individual and small group health benefit plans entered into, amended, extended, or renewed on or after January 1, 2027
