Employees gain the right to ignore employer communications during nonworking hours, defined as time outside assigned work hours established by written agreement

Employers may still contact employees during nonworking hours for emergencies (threats to safety, operational disruptions, physical/environmental damage) or for scheduling changes within 24 hours of the next shift

Employers must establish a workplace policy guaranteeing the right to disconnect that does not reduce employee compensation rights or time-off entitlements

Employees may file complaints with the Commissioner of Labor after three or more documented violations; penalties of at least $100 may be assessed against violating employers
