Creates a private right of action allowing individuals to sue for unauthorized commercial use of their image captured within 25 feet of entrances to essential care facilities (hospitals, abortion clinics, methadone dispensaries, homeless shelters, emergency medical centers)

Prohibits knowingly or recklessly capturing, recording, or using someone's image within this "functional curtilage of care" zone when the primary intent is commercial exploitation without written consent

Exempts law enforcement officers, licensed security guards performing official duties, journalists engaged in legitimate newsgathering on matters of public interest, and personal recordings not used commercially

Allows prevailing plaintiffs to recover actual damages (including emotional distress), punitive damages for intentional or malicious violations, attorney's fees and costs, and injunctive relief

Takes effect July 1, 2026
