Educational technology providers must register annually with the Secretary of State by January 31, pay a $100 fee, and disclose their products, privacy policies, and terms of service.

Schools are prohibited from using educational technology products that have not been certified by the Secretary of State, effective July 1, 2027.

Certification standards will evaluate products for curriculum compliance, data privacy practices, use of AI, geolocation tracking, targeted advertising, and features that could lead to compulsive use.

Certified products cannot collect non-essential student data, behavioral or health data, or use collected data for targeted advertising or sale to third parties; parents must have access to view, correct, and delete their child's data.

Providers failing to register face civil penalties of $50 per day up to $10,000 annually, and violations constitute unfair and deceptive acts enforceable by the Attorney General.
