Creates a new statutory definition of "qualified mental health professional" that includes professionals not employed by designated mental health agencies, expanding eligibility to physicians, psychiatric APRNs, psychologists, social workers, clinical mental health counselors, marriage and family therapists, and psychoanalysts who complete Commissioner-developed training.

Removes the previous narrower definition of "mental health professional" that was limited to professionals designated by the Commissioner.

Authorizes qualified mental health professionals to apply for emergency examination warrants, transport individuals in mental health crises when clinically appropriate, and take patients into custody for return to hospitals following revocation of conditional discharge.

Updates the minor consent statute (§ 8350) to reference the new "qualified mental health professional" definition for outpatient mental health treatment.

Effective date: July 1, 2026.
