Requires chatbot providers to clearly disclose to users that they are interacting with a chatbot rather than a human, with notice provided before any outputs, every hour thereafter, and whenever users ask if the chatbot is a real person

Prohibits using chat logs for targeted advertising, selling user chat logs, and processing data from users under 18 without parental consent; limits chat log retention to 10 years maximum

Grants users the right to access their own chat logs in portable, downloadable formats and prohibits retaliation against users who refuse consent for data training or who access their data

Requires chatbot providers to conduct monthly risk assessments, maintain comprehensive data security programs, and prohibits representing chatbot outputs as equivalent to licensed professionals (doctors, lawyers, accountants, financial planners)

Establishes chatbots as products for liability purposes with providers strictly liable for user injuries; allows private lawsuits with $5,000 liquidated damages per violation plus actual damages, punitive damages, and attorney's fees; effective July 1, 2026
