School districts that do not maintain an elementary or high school must designate up to three eligible schools (Vermont public schools, out-of-state public schools, or certain qualifying recognized independent schools) to serve as the district's public school

Repeals the "approved independent school" category and approval process, while maintaining the "recognized independent school" enrollment process for independent schools

Creates a new definition of "therapeutic school" for recognized independent schools that limit enrollment to students on IEPs or Section 504 plans who are enrolled through written contracts with local education agencies

Requires school districts currently paying tuition to schools of a family's choice to designate eligible schools by July 1, 2029, with students already enrolled in approved independent schools grandfathered until graduation

Takes effect July 1, 2026, with transition provisions allowing school districts to purchase buildings from independent schools that served 60% or more of their students to open new public schools
