Amends RCW 9.94A.535 to add a new aggravating factor for sentencing in controlled substances cases under Washington's Uniform Controlled Substances Act (VUCSA)

Creates a new circumstance allowing courts to impose sentences above the standard range when fentanyl-related offenses cause serious harm

Specifically targets offenses involving the knowing delivery, distribution, or manufacture of fentanyl, fentanyl precursor chemicals, or counterfeit substances containing fentanyl

Enhanced sentencing applies when the fentanyl offense results in substantial bodily harm, permanent cognitive impairment, or death of another person

Requires jury determination of the aggravating factor before the court can impose the enhanced sentence, consistent with existing procedures for exceptional sentences
