All noncompetition covenants are declared void and unenforceable in Washington State beginning June 30, 2026, regardless of when the agreement was signed

Employers are prohibited from enforcing, attempting to enforce, threatening to enforce, or entering into noncompetition covenants with employees or workers

Employers must provide written notice to current employees, former employees, and independent contractors by October 1, 2026 that their existing noncompetition covenants are void

Nonsolicitation agreements remain permitted but are narrowly defined as agreements preventing employees from soliciting current customers or employees away from the employer upon termination

Violations carry penalties of the greater of actual damages or $5,000 statutory penalty, plus attorneys' fees and costs, enforceable by the attorney general or aggrieved individuals
