Agricultural employees may voluntarily waive their right to overtime pay (time-and-a-half for hours over 40/week) for up to 15 workweeks per calendar year, with waivers available in increments of one workweek or more

During waived workweeks, employers must still pay at least the employee's regular rate of pay for all hours worked but are not required to pay overtime premiums

Waivers can be designated for intermittent or contiguous workweeks at the employee's discretion to accommodate peak harvest seasons

Agricultural employers must maintain records of all waivers granted, in addition to existing recordkeeping requirements under RCW 49.30.020
