Health carriers must provide at least 90 days advance notice to health care providers and facilities before implementing any significant payer contract modification, including changes to payment rates, reimbursement methodologies, prior authorization requirements, or site-of-service restrictions.

Notices must specify the affected contract, include the exact language of the modification, contain sufficient information to assess financial impact, and inform providers they may accept or reject the changes in writing during the notice period.

Providers and facilities may reject significant contract modifications without affecting the terms of their existing provider contracts with the carrier.

Carriers must post a summary of all significant payer contract modification notices in a single location on their website and in newsletters at least 90 days before the effective date.

Any significant payer contract modification that fails to comply with notice requirements is void, and contract provisions that violate these requirements are also void.
