Port district employees who participate in a federal railroad retirement plan under the Federal Railroad Retirement Act are excluded from membership in Washington's Public Employees' Retirement System (PERS)

Port district employees covered by a union-sponsored defined benefit pension plan requiring employer contributions under a collective bargaining agreement are also excluded from PERS membership

The exclusion applies for any period during which the port district is making or has made employer contributions to such alternative retirement plans

Amends RCW 41.40.023, which governs membership exceptions in the state retirement system, adding port workers with qualifying alternative pension coverage to the existing list of excluded employee categories
