Real estate brokers are prohibited from marketing residential property sales or leases to limited or exclusive groups of prospective buyers or brokers, unless the property is concurrently marketed to the general public and all other brokers

An exception allows exclusive marketing when reasonably necessary to protect the health or safety of the owner or occupant

Violations constitute an unfair practice under Washington's Law Against Discrimination (RCW 49.60.222) and a violation of real estate licensing requirements (RCW 18.85.361)

The required "Real Estate Brokerage in Washington" pamphlet must be updated to inform consumers that brokers representing sellers must market residential property publicly and cannot limit marketing to exclusive groups
