Changes jail acceptance of federal detainees from mandatory ("shall") to discretionary ("may choose to"), allowing jail administrators to decline federal custody requests when space is available

Requires a formal contract with the United States before any jail accepts federal detainees, except when a valid judicial warrant has been issued

Mandates that contracts include fees covering the total cost to the jail for confining federal detainees

Requires jails to stop holding federal detainees if federal payments are not received or there is indication payments will not be made according to contract terms

Prohibits county and municipal jails from contracting with the United States to hold individuals who have been transported across state lines, unless a valid judicial warrant has been issued
