School districts must provide parents or legal guardians with a copy of special education evaluation reports at least 5 school days before eligibility meetings for initial evaluations or reevaluations.

Reports must be provided in written or electronic format that parents can access, review, and retain; screen sharing or in-meeting review alone does not satisfy the requirement.

Parents may voluntarily waive the 5-day timeline in writing for a specific eligibility meeting; otherwise, districts must reschedule meetings if they cannot meet the deadline.

Failure to provide reports as required constitutes a procedural violation and may be used as evidence in administrative reviews or due process proceedings that parental participation was impeded.

Office of the Superintendent of Public Instruction must update model forms and guidance, and may adopt rules to implement these requirements.
