Attorney General or county prosecuting attorneys may direct Washington State Patrol to collect and securely retain identifying digital data about federal agents who are subjects of misconduct complaints

Federal agent misconduct includes excessive force, assault, kidnapping, unlawful detention, or actions leading to credible federal constitutional rights violation complaints

"Federal agent" covers federal law enforcement officers and private contractors hired by the Department of Homeland Security for law enforcement assistance

Complainants can only access the collected digital data through a court order in civil proceedings alleging federal constitutional rights violations or criminal proceedings involving the subject agent

Identifying digital data includes license plate data, cell tower data, cell phone data, location data, GPS data, Stingray data, facial recognition data, and image search results
