Lowers the blood alcohol concentration (BAC) thresholds for DUI penalties in Washington State, creating a new tier at 0.10 BAC and reducing the highest penalty tier from 0.15 to 0.12 BAC

Adds an intermediate penalty tier for first-time offenders with BAC of 0.10 or higher: minimum 48 hours imprisonment (or 30 days electronic home monitoring), and minimum $500 fine

Reduces the lookback period for felony DUI (three or more prior offenses) from 15 years to 10 years

Requires the Washington State Institute for Public Policy to evaluate the law's impact on traffic crashes, DUI arrests, equity outcomes, and effects on the hospitality industry, with a report due by March 1, 2029

Takes effect July 1, 2026
