Lowers the threshold for felony DUI charges from three prior offenses to two prior offenses within 15 years, making repeat impaired driving a Class B felony for DUI and Class C felony for physical control violations

Maintains existing DUI standards: blood alcohol concentration of 0.08 or higher, or THC concentration of 5.00 or higher within two hours of driving

Applies the same reduced threshold (from three to two prior offenses) for felony charges related to actual physical control of a vehicle while impaired

Takes effect January 1, 2026

Amends RCW 46.61.502 (DUI), RCW 46.61.504 (physical control), and RCW 46.61.5055 (penalty provisions)
