Donors of baby items (clothing, cribs, car seats, strollers, toys, etc.) less than five years old are granted immunity from tort liability for injury, death, or damage caused by donated items, provided donations are made in good faith and without knowledge of defects

Immunity does not apply if the donor knew or should have known the item was unsafe, failed to disclose known defects, or acted with willful misconduct, gross negligence, or intentional wrongdoing

State Board of Health must establish rules by December 31, 2026 for safe receipt and handling of donated baby items by distributing organizations

Department of Health must develop educational materials with health and safety guidelines for donors by December 31, 2026

Effective date is January 1, 2027, and does not affect civil actions pending before that date
