Data centers and their agents are prohibited from entering into nondisclosure agreements or any agreements that conceal development details from the public or prevent public review of the facility

Cities, villages, towns, and counties are similarly prohibited from entering into agreements that hide data center development information from public scrutiny

Political subdivisions must deny permits or project approvals for data centers if the data center, its agents, or the political subdivision itself violates these nondisclosure prohibitions

"Data center" is defined as a Wisconsin facility whose primary services are digital data storage, management, and processing, housing servers, network equipment, telecommunications systems, and related infrastructure

Agreements solely intended to protect trade secrets are exempt from these prohibitions
