Department of Children and Families or county departments serving as representative payee for foster children must conserve the child's state or federal benefits in protected accounts that avoid asset limitations for other programs

Periodic accounting of benefit conservation and use must be provided to the child, their attorney or guardian ad litem, and their parent, guardian, or Indian custodian

Remaining funds must be returned to the child or another fiduciary when the child exits out-of-home care, coordinated with the appropriate federal agency

Departments are prohibited from using a child's benefits to pay for the costs of their out-of-home care

State and county departments may contract with public or private agencies to fulfill these requirements
