Referral agencies must disclose to prospective residents any business relationships with assisted living facilities, the exact referral fee amount the facility will pay, and that only contracted facilities appear on their websites

Prospective residents may terminate all referral agency services at any time, including use of their personal information, by providing written or electronic notice

Referral fees must be set in advance at fair market value, cannot be based on a resident's potential value or percentage of services provided, and can only be collected after the resident confirms in writing they used the agency

Referral agreements for a specific prospective resident cannot exceed one year, and agencies may only collect one fee per referred resident

Violations carry a penalty of up to $1,000 per violation, with the attorney general or district attorney authorized to seek injunctions against non-compliant agencies
