Municipal clerks, chief inspectors, and boards of canvassers must provide election observers uniform and nondiscriminatory access to all stages of the election process, including certification of election technologies, absentee voting, canvassing, elector appeals, vote tabulation, and recounts.

Observation areas must be positioned 3-8 feet from voter check-in tables and voter registration tables to allow observers to readily view all public aspects of voting.

Election officials who violate observer access requirements may face up to 90 days in county jail, a fine of up to $1,000, or both.

Recount procedures must comply with election observer access requirements, allowing candidates and their representatives to view and identify all materials and ballots.
