Expands existing prohibitions on previously deployed airbags to also cover importing, manufacturing, and offering for sale, and creates new prohibitions for nonfunctional and counterfeit airbags

Defines "nonfunctional airbag" as a replacement airbag that was previously deployed or damaged, has an electric fault detected by the vehicle's diagnostic system, includes parts intended to mislead owners into believing a functional airbag is installed, or is prohibited from sale under federal law

Defines "counterfeit airbag" as a replacement airbag or component displaying an unauthorized mark substantially similar to an original equipment manufacturer's mark

First offense remains punishable by up to $5,000 fine and/or up to one year imprisonment; second or subsequent offense elevated to Class I felony

Creates enhanced felony penalties when violations result in bodily harm (Class H felony), great bodily harm (Class G felony), or death (Class F felony)
