Department of Agriculture, Trade and Consumer Protection (DATCP) must establish a voluntary registration program for commercial deicer applicators, including training criteria focused on water quality protection and certification of third-party training providers.

Commercial applicators who complete DATCP-approved training and pass an examination receive registration valid for 5 years; government employees are excluded from the program.

Registered applicators and property owners who contract with them receive a presumption of non-liability for snow/ice-related injuries when approved methods are followed, though liability remains for reckless conduct, intentional misconduct, or failure to use trained methods.

Registered applicators must maintain records for at least 3 years documenting deicer types and amounts used, treatment dates, and weather conditions, and must submit annual deicer usage reports to DATCP by July 1.

DATCP may revoke registration for non-compliance, with applicators entitled to a contested case hearing if requested within 30 days of revocation notice.
