Health insurance policies and self-insured governmental health plans are prohibited from using artificial intelligence to deny prior authorization requests based on medical necessity or experimental treatment status

A licensed health care provider who is an individual must review any prior authorization involving medical necessity or experimental status before a denial can be issued

Applies to disability insurance policies, self-insured health plans, limited service health organizations, preferred provider plans, and defined network plans

Takes effect on the first day of the 4th month after publication, applying to policy or plan years beginning on that date

Plans affected by collective bargaining agreements have delayed applicability until the agreement is newly established, extended, modified, or renewed
