Persons planting 5 or more acres of potatoes in Wisconsin must use seed potatoes certified under ATCP 156, Wis. Adm. Code

The department may waive the certification requirement for specific potato varieties or genotypes when insufficient certified seed is available and the uncertified seed poses no serious disease threat, with possible geographic restrictions on planting

Violators may be ordered to remove and destroy all seed potatoes and potatoes within 72 hours; if they fail to comply, the department or local government may conduct removal and destruction and assess costs as taxes against the violator

Penalties include forfeitures of up to $5,000 plus up to $5,000 per full acre planted in violation, which may be waived if the violator complies with destruction orders

Affected parties may request a hearing before the department within 10 days of receiving an enforcement order
