Foreign nationals are prohibited from making direct or indirect contributions to referendum committees, and referendum committees are prohibited from receiving, soliciting, or accepting such contributions.

Foreign nationals may not direct, control, or participate in decision-making regarding activities to support or oppose a referendum, nor solicit others to make contributions or expenditures to influence a referendum.

Referendum and independent expenditure committees must obtain written affirmations from contributors stating they are not foreign nationals and have not accepted more than $100,000 from foreign nationals in the preceding 4-year period.

Committees must attest in each report filed with the Ethics Commission that they have obtained all required affirmations and have not received foreign national contributions exceeding $100,000 in the preceding 4 years.

Referendum committees must affirm in their registration statements that no preliminary activity (including polling, communications, and ballot language analysis) was funded by foreign nationals.
