Prohibits the West Virginia Department of Human Services from requiring foster or adoptive parents to affirm, accept, or support government policies on sexual orientation or gender identity that conflict with their sincerely held religious or moral beliefs

Bars the department from denying foster or adoption eligibility based on a parent's religious or moral beliefs about sexual orientation or gender identity

Prevents the department from excluding prospective parents from placement consideration based on their beliefs, and prohibits using such beliefs to create a presumption that a placement is not in a child's best interest

Allows the department to consider the religious or moral beliefs of the child or their family of origin, including beliefs about sexual orientation and gender identity, when determining appropriate placements on a case-by-case basis

Provides legal protections for foster and adoptive parents, allowing them to seek injunctive relief, compensatory damages, and attorney fees if their rights under this section are violated
