Requires the Commissioner of Highways to develop and propose a formula for allocating state and federal road funds among West Virginia's 10 road maintenance districts and counties, to be submitted as a legislative rule during the 2026 regular session

Mandates the formula include six specific factors: county population, population growth projections, total lane miles, vehicle miles traveled, heavy truck miles traveled, and number and condition of bridges

Establishes a public comment period requiring the commissioner to implement a mechanism by October 1, 2025, to solicit public input for at least six weeks, with all comments posted on the department's website

Guarantees no district receives less funding than the highest amount received in the previous five fiscal years, unless the overall Division of Highways budget is reduced

Allows districts discretion to distribute funds among counties within a five-year period, provided all counties receive their formula-apportioned funds by the end of that period
