Drivers approaching stationary vehicles displaying warning signals (flashing lights, emergency flashers, hazard lights, flares, or retroreflective signs) must change lanes away from the vehicle when safe, or reduce speed to 15 mph on nondivided roads and 25 mph on divided highways

Basic violation is a misdemeanor punishable by up to $500 fine and/or up to 60 days in county or regional jail

License suspensions escalate based on harm caused: 90 days for property damage, 6 months for injury to another person, and 2 years for causing death

Violating this law while also under the influence of alcohol or drugs (per §17C-5-2) results in an additional fine of $1,000-$5,000 and/or up to 6 months jail time on top of other penalties

Effective July 11, 2025 (90 days after passage on April 12, 2025)
