Defines "abortifacient" as any FDA-regulated or non-FDA approved drug, substance, or chemical primarily used to cause an abortion, and creates new prohibitions on their distribution in West Virginia

Makes it a felony to perform or attempt to perform an abortion using an abortifacient, punishable by up to 10 years imprisonment and/or fines up to $100,000

Prohibits "foreign senders" from mailing or shipping abortifacients into West Virginia, including those who prescribe such drugs to state residents regardless of the prescriber's location

Allows pregnant women who receive abortifacients to bring civil lawsuits against violators, with damages of $10,000 per abortion performed or attempted, plus injunctive relief

Provides affirmative defenses for physicians performing legitimate medical procedures resulting in accidental fetal injury/death and pharmacies filling valid prescriptions from West Virginia-licensed physicians
