West Virginia higher education institutions may directly compensate student-athletes for name, image, and likeness (NIL) rights and share athletic department revenues with them

Institutions can negotiate, facilitate, and enter into NIL agreements with student-athletes, including setting conditions such as prohibited endorsements and disclosure requirements

Athletic associations, conferences, and governing bodies (such as the NCAA) are prohibited from penalizing, investigating, or declaring ineligible any student-athlete or institution for engaging in NIL activities authorized under this law

Student-athletes are prohibited from earning NIL compensation related to alcohol, cannabis, tobacco, controlled substances, adult entertainment, casinos, or sports betting

Aggrieved student-athletes may seek injunctive relief, and institutions facing adverse action from athletic associations for permitted NIL activities may recover actual damages and attorney fees
