Establishes mandatory minimum setback distances for wind turbines from non-participating landowners' property lines at 1.1 times the total height of the tower, turbine, and maximum blade height

Requires wind turbines to be set back at least 1.5 times their total height from non-participating landowners' residences (including single/multi-family dwellings, schools, and licensed healthcare facilities)

Mandates setbacks of 1.1 times total turbine height from paved public roads and overhead transmission lines of 115kV capacity or greater

Applies only to wind energy systems exceeding 500 kilowatts of potential generation and only to new siting certificate applications filed after the effective date

Allows property owners to sign written waivers permitting wind turbines to be placed closer than the minimum setback requirements
